Any willful violation of this Policy or the Copyright Clearance Procedure by an Employee shall subject the person in violation to a disciplinary action according to established procedures. In any case wherein there is a willful violation of this Policy or the Copyright Procedure by an Employee, the person in violation shall be regarded by Fielding Graduate University as outside the course and scope of his or her employment at Fielding. All other members of the Fielding community, including students and graduates, are also urged to be cognizant of, and comply with, the developing copyright laws of the U.S. and/or other countries, as applicable to them. The Technology Resources Policy, which applies to all users of Fielding's information and communication systems, includes a section on Respect for Intellectual Property. These policies inform the Fielding community of the university's processes related to use and distribution of copyrighted materials, stipulate standards for conduct in the use and distribution of these materials, and reduce the university's potential risk of legal liability. To that end, any question regarding the extent, meaning or application of the Copyright Clearance Procedure or this Policy (including determinations as to "Fair Use") shall be submitted to the Provost's standing Copyright Issues Committee, which can be emailed at CIC@fielding.edu (and will consult with Fielding's Legal Counsel as needed).
